I have received the following press release which I reproduce verbatim. Apologies for legalese - and for any duplication. Wendy July 1, 1998 InfoChem GmbH and InfoChimia GmbH win lawsuit against Beilstein Informationssysteme GmbH Munich, Germany - In the lawsuit InfoChem GmbH (Munich) and its subsidiary InfoChimia GmbH (Berlin) against Beilstein Informationssysteme GmbH (Frankfurt) concerning the worldwide marketing of VINITI's structural database covering the period 1989-2000 by Beilstein Informationssysteme GmbH the courts of Berlin have rendered a judgment which is final and absolute. Pursuant to this judgment Beilstein Informationssysteme GmbH must abstain from offering or distributing by themselves or by a third party the VINITI database of chemical compounds and reactions. Further, the court held Beilstein Informationssysteme GmbH liable for damages originated from allegations in its press release of July 25, 1997 concerning the conclusion of an agreement with VINITI on the worldwide marketing of VINITI's structural and reaction database of the period 1989-2000. This agreement was never in fact completed. In its opinion the court stated that the VINITI database without any limitation concerning the time of the literature period considered belongs to VINITI and InfoChimia due to their joint ownership. Therefore, VINITI may not dispose of any data of this file or make any contracts concerning the distribution of these data without InfoChimias consent. -- Dr Wendy A Warr Wendy Warr & Associates, 6 Berwick Court Holmes Chapel, Cheshire CW4 7HZ, England Tel/fax +44 (0)1477 533837 wendy@warr.com http://www.warr.com chemweb: A list for Chemical Applications of the Internet.
